Dear Sir or Madam: I would like a clarification on procedure with respect to one of the amendments to the G.C.A. of 1968 mentioned in "Open Letter to all Federal Firearm Licensees" dated 11-26-96. 1) If I sell a C&R firearm at an out of state gun show to a dealer licensed in that state may he immediately sell that firearm to an individual (on a 4473 form)? A written reply would be appreciated. Thank you for your time. Sincerely, DEPARTMENT OF THE TREASURY BUREAU OF ALCOHOL, TOBACCO AND FIREARMS WASHINGTON, DC 20226 JAN 13 1997 Dear : This is in response to your letter requesting information on the sale of curio and relic firearms. You would like to know if a curio or relic firearm you sell at an out of state gun show to a dealer licensed in that state can immediately be sold by that dealer to an unlicensed individual. The answer to your question is yes provided all Federal, State and local requirements are met by the dealer selling the firearm to the individual. For example, if the Federal 5-day waiting period applies in that State or there is separate waiting period required by State law. If you have any further questions, please do not hesitate to contact us. Sincerely yours, [signed] Charles R. Bartlett Acting Chief, Firearms and Explosives Operations Branch
