DEPARTMENT OF THE TREASURY Bureau of Alcohol, Tobacco and Firearms Washington, D.C. 20226 JUNE 17, 1994 C:F:N:BAN 5320 Mr. XXX Address City, State Dear Mr. XXX: This is in response to your letter dated May 26, 1994, expressing your concerns to the registration status of a firearm; if the law changes while a firearm is transferred elsewhere for repair. In an effort to never place a lawful firearm owner in violation of any Federal, State or local firearms laws and regulations, we ask that he/she completes ATF Form 5 and receive our permission prior to submitting the firearm to the gunsmith for repair; and the gunsmith must do the same prior to returning the firearm. {We search and apply the applicable firearms laws during each transaction.} These measurements are also taken to insure the National Registry is always reflecting accurate information. Even though we approved the appropriate paperwork in order for a person to initially acquire a National Firearms Act firearm; and later approved the ATF Form 5 to transfer the firearm to a gunsmith for repair should have no bearing on anyone always adhering to any changes in the Federal, State and local firearms laws and regulations. We hope we have been responsive to your needs. If we can be of further assistance to you, in any way, please do not hesitate to write or call us at (202) 927-8330. Sincerely, [signed A. Stevens] for Carmen L. Lewis Acting Chief, National Firearms Act Branch
