DEPARTMENT OF THE TREASURY BUREAU OF ALCOHOL, TOBACCO AND FIREARMS WASHINGTON, DC 20226 DEC -3 1999 903050:EMO 3311 Dear Mr. : This is in reply to your letter dated November 16, 1999, in which you ask about a Heckler & Koch HK93 rifle receiver with a barrel length of less than 16 inches and without a trigger pack attached to the receiver. Title 26, U.S.C., section 5845(a)(3) defines the term firearm as a rifle having a barrel or barrels of less than 16 inches in length. Section 5845(a)(4) defines the term firearm as a weapon made from a rifle if such weapon as modified has an overall length of less than 26 inches or a barrel or barrels of less than 16 inches in length. Section 5845(c) defines the term rifle as a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder and designed or redesigned and made or remade to use the energy of the explosive in a fixed cartridge to fire only a single projectile through a rifled bore for each single pull of the trigger. The term also includes any such weapon which may be readily restored to fire a fixed cartridge. The weapon in question may be readily restored to fire by replacing the trigger pack. Therefore the HK93 in question is a short barrel rifle as defined. -2- Mr. We trust that the foregoing has been responsive to your inquiry. If we can be of any further assistance, please contact us. Sincerely yours, Edward M. Owen, Jr. Chief, Firearms Technology Branch
