N-90-25(EBB) BILLISTICS, INCORPORATED THIRD ORDER CONCERNING THE DISPOSITION OF 11 REMAINING SEIZED FIREARMS By a third joint motion filed December 18, 1991, the United States Government and Billistics, Incorporated ("Billistics") seek a third order in the captioned matter directing the Bureau of Alcohol, Tobacco and Firearms ("BATF") to dispose of the 11 remaining firearms in the BATF's custody. In their third joint motion, the parties represent that: 1. On July 26, 1989, BATF agents executed a federal search warrant and seized from Billistics the 156 firearms listed on the accompanying Exhibit 1. 2. They seek an order concerning the disposition of 11 firearms listed as items 25, 27, 43, 54, 57, 58, 59, 88, 89, 104, and 139 in Exhibit 1 and remaining in the BATF's custody. 3. The BATF will return items 27 and 139 to their registered owners. 4. The BATF will return items 25, 43, 54, 57, 58, 59, 88, 89, and 104 to Billistics as expressed in letters from the items' registered owners that Billistics provided to the - 2 - Government, and which accompany the third joint motion, and it will reflect those transfers in its NFA Registry. 5. The third joint motion is not to be construed as an admission that Billistics or its officers violated any federal firearms law or that the agents of the Government acted improperly in obtaining a search warrant and seizing the firearms. The motion is merely an effort to expedite the disposition of the firearms. 6. The granting of the motion will result in the final disposition of the firearms listed on Exhibit 1. Based on the parties' motion, the Court grants the third motion and issues the following order: IT IS ORDERED that the BATF shall, as soon as practicable, return items 27 and 139 to their registered owners; IT IS FURTHER ORDERED that the BATF shall, as soon as practicable, return to Billistics the firearms listed as items 25, 43, 54, 57, 58, 59, 88, 89, and 104 in Exhibit 1, and reflect those transfers in its NFA Registry; and IT IS FINALLY ORDERED that the BATF provide Billistics and the registered owners with a copy of this Order without the attached Exhibit 1 at the time the firearms are returned.
